Terms governing access to and use of www.vitalexltd.co.uk
1. About us
Vitalex Ltd is a company registered in England and Wales under company number 16068365. Our registered office is The Stamp Exchange, 7 Westgate Road, Newcastle upon Tyne, NE1 1SA. Our VAT number is 489 4928 16. Our website is www.vitalexltd.co.uk.
Vitalex is a specialist distributor of single-use surgical procedure packs, sterile draping sets and gowns to healthcare, dental and veterinary providers.
2. Scope of these Terms
These Terms of Use govern access to and use of our website, including product information, sustainability information, downloadable materials, enquiry forms and any other website content. By using the website you agree to these Terms. If you do not agree, please do not use the website.
The website is intended for business, healthcare, procurement, clinical, veterinary and other professional users. It does not offer products for sale to consumers and no order can be placed or completed through it. Any supply of products or services is governed by the applicable quotation, accepted order, written agreement and our Terms and Conditions of Sale.
3. Information only: no clinical advice
Website content is provided for general commercial and product-information purposes. It is not medical, clinical, veterinary, legal, regulatory or waste-management advice, and it must not be used in place of professional judgement, local policy, the product label, the current instructions for use, the declaration of conformity, technical documentation, applicable waste guidance or a formal product evaluation.
Healthcare and veterinary professionals remain responsible for determining whether a product, pack configuration or component is suitable for a particular procedure, patient, animal, clinical pathway and local protocol.
4. Product information and regulatory status
We take reasonable care to keep product information accurate and current. Product descriptions, images, dimensions, component lists, availability, shelf life, lead times and regulatory information may nevertheless change. The most recent written quotation, approved specification, product label and instructions for use take priority over anything on this website.
Where we refer to CE marking, UKCA marking, ISO 13485-certified manufacturing facilities or other regulatory or quality information, that statement applies only to the specific product, manufacturer, facility or market for which the supporting evidence exists.
What we do not claim
Vitalex Ltd does not itself hold ISO 13485 certification. Where we refer to ISO 13485, we are describing the certification held by the manufacturers we work with, not by Vitalex.
Registration of a device with the MHRA is a statutory notification requirement. It is not approval, accreditation, certification or endorsement by the MHRA, and we do not present it as such.
Different medical-device rules apply in Great Britain and in Northern Ireland. Product availability and conformity status must be confirmed for the market in which the product will actually be supplied.
5. Custom and bespoke procedure packs
Examples of custom or bespoke packs shown on the website are illustrative only. A bespoke pack is not approved for supply until the component specification, intended use, applicable regulatory position, quantities, minimum order requirements, lead time and commercial terms have all been confirmed in writing.
We may decline a requested configuration where we consider it would be unsafe, incompatible, technically impracticable, outside the manufacturer’s validated process or intended use, or inconsistent with applicable regulatory requirements.
6. Sustainability and GreenCycle information
Sustainability statements on this website are based on the evidence and methodology available to us at the time of publication.
GreenCycle is our two-stream surgical waste recovery service. Documentation issued under it is supplier-provided evidence intended to complement a customer’s own environmental, waste and reporting processes. It does not replace any statutory or governance obligation that rests with the customer. GreenCycle is not NHS-approved, NHS-certified or NHS-endorsed, and we do not describe it as such.
Where recovery or diversion figures are quoted, they come from actual collection, treatment and waste-transfer data provided by our recovery partners. We do not publish modelled or estimated figures as though they were measured.
7. Reporting a product concern
If you have a concern about the quality, packaging, sterility or safety of a product supplied by Vitalex, please tell us as soon as possible. Email customerservices@vitalexltd.co.uk with “Product Quality Concern” in the subject line, or telephone 0330 133 7551.
Where you can, please include the product code, lot or batch number, expiry date, quantity affected, delivery details and a description of the concern. Please quarantine and retain the affected product and its packaging where it is safe and practicable to do so.
We acknowledge product-safety concerns within one working day and pass the relevant information to the legal manufacturer without undue delay. Suspected adverse incidents involving a medical device can also be reported to the MHRA directly through its Yellow Card scheme.
8. Website availability and changes
We may update, suspend, withdraw or change any part of the website without notice where reasonably necessary, including for maintenance, legal compliance, cybersecurity, product changes or commercial reasons. We do not guarantee that the website or any content will always be available or uninterrupted.
9. Acceptable use
You must not misuse the website. In particular you must not knowingly introduce malware, attempt unauthorised access, interfere with the website’s operation, scrape or extract content at a scale that harms the service, impersonate another person or organisation, submit unlawful material, or use the website in a way that infringes another person’s rights.
10. Files and information you send us
Where the website allows you to upload a preference card, component list, specification or other file, you confirm that you are authorised to provide it and that doing so does not breach any confidentiality, intellectual-property or data-protection obligation.
Please do not send us patient-identifiable information
We do not need or invite patient-identifiable information through website forms, quotation requests or ordinary commercial email. Please remove patient identifiers before you send us a preference card or specification.
If a product-safety or complaint matter genuinely requires sensitive information, contact us first so that a secure route and the minimum necessary data can be agreed.
We use submitted commercial specifications and enquiry information to respond to your request, prepare quotations, assess technical feasibility and administer a potential or existing customer relationship, in accordance with our Privacy Policy.
11. Intellectual property
Unless stated otherwise, the website and its text, design, graphics, branding, product codes, photographs, documents and other content are owned by or licensed to Vitalex Ltd and are protected by intellectual-property law. You may view, print or download reasonable extracts for your organisation’s internal evaluation or procurement purposes. You must not reproduce, modify, republish, sell or commercially exploit our content without our prior written permission.
12. Third-party links and services
The website may link to third-party websites, documents, mapping services or other resources. Links are provided for convenience and do not mean that we control or endorse the third-party content. Third-party services are subject to their own terms and privacy information.
13. Liability
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.
Subject to that, we are not responsible for losses arising solely from reliance on general website content where the user has not checked the current product documentation, quotation or applicable professional requirements. To the extent permitted by law, we are not responsible for indirect or consequential loss arising from ordinary use of the website.
14. Privacy, cookies and storage technologies
Personal data is handled in accordance with our Privacy Policy. Cookies and similar storage and access technologies are handled in accordance with our Cookie and Storage Technologies Notice and the choices presented through the website’s consent controls.
15. Governing law
These Terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, except where mandatory law requires otherwise.
16. Contact
Questions about these Terms can be sent to customerservices@vitalexltd.co.uk, by telephone to 0330 133 7551, or by post to The Stamp Exchange, 7 Westgate Road, Newcastle upon Tyne, NE1 1SA.
